Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Teslink LLC, a limited liability company ("Teslink," "Company," "we," "us," or "our"), governing your access to and use of the Teslink Solar mobile application (the "App"), the website located at teslink.co (the "Site"), and all related services, features, content, and functionality (collectively, the "Service").

By downloading, installing, accessing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must immediately cease all use of the Service and delete the App from your device.

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms within the App or sending a notification to your registered email address at least thirty (30) days before the changes take effect. Your continued use of the Service after the effective date of any modification constitutes your acceptance of the modified Terms.

2. Eligibility

You must be at least eighteen (18) years of age, or the age of majority in your jurisdiction, to use the Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

The Service is currently available to residents of the United States. We may expand availability to additional jurisdictions at our discretion. You are responsible for ensuring that your use of the Service complies with all laws applicable to you.

3. Account Registration and Security

To use the Service, you must create an account using a valid email address, Google Sign-In, or Sign in with Apple. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate.

You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to immediately notify us at support@teslink.co if you become aware of any unauthorized use of your account.

We reserve the right to suspend or terminate your account if any information provided proves to be inaccurate, misleading, or incomplete, or if we reasonably believe your account has been compromised.

4. Tesla Account Linking and Data Access

4.1 Authorization

The Service allows you to link your Tesla account to access energy data from your Tesla Solar panels, Powerwall battery system, and related energy products. By linking your Tesla account, you authorize Teslink to access your Tesla energy data through the Tesla Fleet API using the OAuth 2.0 authorization protocol. This authorization is limited to read-only access to your energy production, consumption, battery, and grid data. Teslink will never write data to or control your Tesla devices.

4.2 Token Management

When you link your Tesla account, Tesla provides authentication tokens that allow Teslink to access your data on your behalf. These tokens are encrypted using AWS Key Management Service (KMS) and stored securely. Tokens are refreshed automatically and may be revoked by you at any time by unlinking your Tesla account within the App.

4.3 No Affiliation with Tesla

Teslink is not affiliated with, endorsed by, or sponsored by Tesla, Inc. Tesla, Powerwall, and related marks are trademarks of Tesla, Inc. The Service is an independent third-party application that accesses publicly available APIs provided by Tesla. Tesla may modify, restrict, or discontinue its API at any time, which may affect the functionality of the Service.

4.4 Data Accuracy

While we strive to present your Tesla energy data accurately, Teslink does not guarantee the accuracy, completeness, or timeliness of data retrieved from the Tesla Fleet API. Data discrepancies may occur due to API limitations, network issues, processing delays, or changes to Tesla's systems. The data presented in the App is for informational purposes only and should not be relied upon for critical energy management or financial decisions.

5. Description of the Service

Teslink Solar provides analytics, visualizations, historical trends, alerts, and insights for Tesla Solar ecosystem owners. The Service includes, but is not limited to:

  • Energy production and consumption dashboards
  • Historical data analysis and trend visualization
  • Battery utilization and self-sufficiency metrics
  • Customizable alerts and notifications
  • Data export functionality
  • Score-based performance assessments

The Service operates on a read-only, historical data basis. We pull data from the Tesla Fleet API at intervals determined by your subscription tier. We do not provide real-time monitoring, and data may be delayed.

6. Subscription Plans and Payment

6.1 Subscription Tiers

The Service offers subscription tiers with varying feature access, including data pull frequency, historical data retention, chart granularity, alert capabilities, and export functionality. Current tier details and pricing are displayed within the App and on the Site. Pricing is subject to change with thirty (30) days' notice.

6.2 Free Trial

New users may receive a fourteen (14) day free trial of the paid subscription tier. The trial begins on the date you subscribe. You may cancel at any time during the trial without being charged. If you do not cancel before the trial period ends, your subscription will automatically convert to a paid subscription, and you will be charged the applicable fee.

6.3 Payment Processing

All payments are processed exclusively through Apple's App Store (via StoreKit) for iOS users and Google Play Billing for Android users. Teslink does not directly collect, process, or store payment information such as credit card numbers. All billing disputes must be directed to Apple or Google, as applicable.

6.4 Automatic Renewal

Subscriptions automatically renew at the end of each billing period (monthly or annually) unless you cancel at least twenty-four (24) hours before the end of the current period. You may manage your subscription and turn off auto-renewal through your Apple App Store or Google Play account settings.

6.5 Refunds

Refund eligibility is governed by Apple's App Store or Google Play refund policies, as applicable. Teslink does not have the ability to process refunds directly. If you believe you are entitled to a refund, please contact Apple or Google through their respective support channels.

6.6 Price Changes

We may change subscription pricing at any time. Price changes for existing subscribers will take effect at the start of the next billing period following at least thirty (30) days' notice. If you do not agree to a price change, you may cancel your subscription before the new price takes effect.

7. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable law or regulation
  • Attempt to reverse-engineer, decompile, disassemble, or otherwise attempt to discover the source code of the Service
  • Interfere with, disrupt, or place an unreasonable burden on the Service or its infrastructure
  • Use automated scripts, bots, or other means to access the Service beyond the intended user interface
  • Attempt to access data belonging to other users
  • Resell, sublicense, or commercially exploit the Service or any data obtained through it without our express written consent
  • Circumvent, disable, or otherwise interfere with security features of the Service
  • Impersonate another person or entity
  • Use the Service to transmit malware, viruses, or other harmful code
  • Share your account credentials with any third party

8. Intellectual Property

The Service, including its design, features, functionality, content, branding, logos, documentation, and underlying code, is owned by Teslink LLC and is protected by United States and international copyright, trademark, trade secret, and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App on your personal device solely for your personal, non-commercial use in accordance with these Terms. This license does not include the right to modify, distribute, sell, lease, or create derivative works based on the Service.

Your energy data remains your property. By using the Service, you grant us a limited license to process, analyze, store, and display your energy data solely to provide and improve the Service. We may use aggregated, anonymized data that does not identify you for analytics, benchmarking, research, and service improvement purposes.

9. Data Retention and Deletion

We retain your processed energy data for as long as your account is active to provide you with historical analytics and trends. Raw API response data is archived and tiered to lower-cost storage over time. If you delete your account, we will delete your personal data and energy data within thirty (30) days, except where retention is required by law or for legitimate business purposes (such as fraud prevention or dispute resolution). Aggregated, anonymized data may be retained indefinitely.

10. Service Availability and Modifications

We strive to maintain continuous availability of the Service but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, server issues, or circumstances beyond our control, including but not limited to changes or disruptions to the Tesla Fleet API.

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. If we permanently discontinue the Service, we will provide at least sixty (60) days' notice and allow you to export your data.

11. Third-Party Services

The Service integrates with or relies upon third-party services, including but not limited to: Tesla Fleet API (for energy data), Apple App Store and Google Play (for payments and distribution), Amazon Web Services (for cloud infrastructure), Firebase Cloud Messaging (for push notifications), and authentication providers (Google and Apple). We are not responsible for the availability, accuracy, or practices of any third-party service. Your use of third-party services is subject to their respective terms and policies.

12. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR AVAILABILITY.

WITHOUT LIMITING THE FOREGOING, TESLINK DOES NOT WARRANT THAT: (A) THE SERVICE WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS; (B) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; (C) THE DATA, ANALYTICS, SCORES, OR INSIGHTS PROVIDED WILL BE ACCURATE, RELIABLE, OR COMPLETE; (D) ANY ERRORS OR DEFECTS WILL BE CORRECTED; OR (E) THE SERVICE WILL BE COMPATIBLE WITH YOUR DEVICES OR TESLA PRODUCTS.

THE SCORES, ANALYTICS, AND INSIGHTS PROVIDED BY THE SERVICE (INCLUDING BUT NOT LIMITED TO SOLAR SCORES, SAVINGS SCORES, AND PERFORMANCE ASSESSMENTS) ARE FOR INFORMATIONAL PURPOSES ONLY. THEY DO NOT CONSTITUTE PROFESSIONAL ENERGY, FINANCIAL, TAX, OR INVESTMENT ADVICE. YOU SHOULD NOT MAKE FINANCIAL OR ENERGY MANAGEMENT DECISIONS BASED SOLELY ON INFORMATION PROVIDED BY THE SERVICE.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TESLINK LLC, ITS OFFICERS, DIRECTORS, MEMBERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH: (A) YOUR USE OF OR INABILITY TO USE THE SERVICE; (B) ANY ERRORS, INACCURACIES, OR OMISSIONS IN THE DATA OR ANALYTICS PROVIDED; (C) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA; (D) THE CONDUCT OF ANY THIRD PARTY ON THE SERVICE; (E) CHANGES TO OR DISCONTINUATION OF THE TESLA FLEET API; OR (F) ANY OTHER MATTER RELATING TO THE SERVICE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF: (I) THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (II) ONE HUNDRED DOLLARS ($100.00).

Some jurisdictions do not allow the exclusion or limitation of certain damages. If these laws apply to you, some or all of the above limitations may not apply, and you may have additional rights.

14. Indemnification

You agree to indemnify, defend, and hold harmless Teslink LLC and its officers, directors, members, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any rights of a third party; (d) your violation of any applicable law or regulation; or (e) any content you submit or transmit through the Service.

15. Termination

You may terminate your account at any time by deleting your account through the App settings or by contacting us at support@teslink.co. Upon termination, your right to use the Service will immediately cease.

We may suspend or terminate your account and access to the Service at any time, with or without cause and with or without notice, including but not limited to if we reasonably believe you have violated these Terms. Upon termination, we will delete your data in accordance with Section 9.

Sections 8 (Intellectual Property), 12 (Disclaimers), 13 (Limitation of Liability), 14 (Indemnification), 16 (Governing Law), and 17 (Dispute Resolution) shall survive any termination of these Terms.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the state and federal courts located in Ventura County, California.

17. Dispute Resolution

17.1 Informal Resolution

Before filing any formal legal action, you agree to first attempt to resolve any dispute informally by contacting us at support@teslink.co. We will attempt to resolve the dispute informally within sixty (60) days.

17.2 Binding Arbitration

If the dispute is not resolved informally, you and Teslink agree to resolve any remaining dispute through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration shall take place in Ventura County, California, or remotely at your election. The arbitrator's decision shall be final and binding.

17.3 Class Action Waiver

YOU AND TESLINK AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.

17.4 Exceptions

Either party may bring claims in small claims court if eligible. Either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights.

18. General Provisions

Entire Agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Teslink regarding the Service and supersede all prior agreements and understandings.

Severability. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

Waiver. Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.

Assignment. You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.

Force Majeure. We shall not be liable for any failure or delay in performing our obligations due to circumstances beyond our reasonable control, including but not limited to natural disasters, acts of government, internet or power outages, or third-party service disruptions.

Notices. We may send notices to you via email, push notification, or in-app messaging. You may send notices to us at support@teslink.co or by mail to the address listed on our website.
